1. Acceptance of Terms

In short: By using Picker Radar, you agree to these terms. If you don't agree, don't use the service.

These Terms of Service ("Terms") are a binding legal agreement between you and Qualuxe Goods LLC ("we," "us," or "our"), the company that operates Picker Radar at pickerradar.com (the "Service"). By creating an account, accessing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.


2. What Picker Radar Does

In short: We help thrift-store resellers estimate resale value. Our estimates are tools, not guarantees.

Picker Radar is a web-based tool that lets resellers photograph or scan potential thrift-store inventory and receive estimated resale pricing based on eBay sold-listing data, along with a Pick / Leave recommendation. The Service uses AI-assisted image analysis to identify items and retrieve comparable sold listings from publicly available eBay data via a third-party data service.

Picker Radar is intended as a decision-support tool. It does not guarantee resale prices, guarantee item authenticity, or constitute investment or financial advice.


3. Accounts and Eligibility

In short: You must be 13 or older, keep your account secure, and provide accurate information.

3.1 Eligibility

You must be at least 13 years old to use Picker Radar. By creating an account you represent that you meet this requirement. The Service is intended for users located in the United States. We do not knowingly allow use by children under 13; if we learn a user is under 13 we will terminate the account.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@pickerradar.com if you suspect unauthorized access. We are not liable for losses caused by unauthorized use of your account.

3.3 Accurate Information

You agree to provide accurate, current, and complete information when creating your account and to keep that information updated. Accounts created with false information may be suspended or terminated.

3.4 One Account Per Person

Each person may maintain only one active free-tier account. Creating multiple accounts to circumvent scan limits or promotional terms is prohibited.


4. Subscriptions and Billing

In short: Subscriptions auto-renew. You can cancel any time. See our Refund Policy for how refunds work. California residents: see the auto-renewal notice below.

4.1 Subscription Plans

We offer Free, Starter, Hobby, and Pro plans. Paid plans are billed on either a monthly or annual basis at the rates listed on our pricing page. Plan features (scan allotments, access levels) are described on the pricing page and may be updated with notice as described in Section 4.5.

4.2 Auto-Renewal Disclosure

Important — California Auto-Renewal Notice (Cal. BPC §17602): Paid subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current subscription rate unless you cancel before the renewal date. Your payment method on file will be charged automatically at renewal. You may cancel at any time from your account settings page; cancellation stops auto-renewal but does not issue a mid-cycle refund except as described in our Refund Policy. To cancel, go to Account → Subscription → Cancel Plan, or contact us at support@pickerradar.com.

4.3 Payment Processing

All payments are processed by Stripe, Inc. We do not store your full payment card details on our servers. By providing payment information, you authorize us to charge the applicable fees to your payment method. You agree to Stripe's Terms of Service.

4.4 Taxes

Subscription fees do not include applicable taxes. You are responsible for all applicable taxes assessed on your purchases. We may collect sales tax where required by law.

4.5 Price Changes

We may change subscription prices at any time. We will notify you at least 30 days before a price increase takes effect via email to your account address. Continued use after the effective date constitutes acceptance of the new price. If you do not agree, you may cancel before the increase takes effect.

4.6 Free Tier

The Free plan provides 5 lifetime scans. Once exhausted, scans are permanently used up on the Free plan; they do not reset. Upgrading to a paid plan grants the scan allotment of the selected tier going forward.

4.7 Refunds

Refunds are governed by our Refund Policy, which is incorporated here by reference.


5. Acceptable Use

In short: Use the Service for its intended purpose. Don't scrape it, abuse it, or upload harmful content.

Your use of Picker Radar is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. Key restrictions include:

Violation of the Acceptable Use Policy may result in immediate account suspension or termination.


6. Intellectual Property

In short: We own the platform. You own the photos you upload, but you give us permission to process them to deliver the Service.

6.1 Our Property

Qualuxe Goods LLC owns or licenses all rights in the Picker Radar platform, including its software, algorithms, UI design, brand assets, and aggregated or derived data outputs. These Terms do not transfer any ownership interest in the platform to you.

6.2 Your Content

You retain ownership of photos and other content you upload to Picker Radar ("Your Content"). By uploading content, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, transmit to third-party AI and data services, and use Your Content solely to provide the Service to you. This license terminates when you delete the content or close your account, subject to the retention periods described in our Privacy Policy.

6.3 Feedback

If you submit suggestions or feedback about the Service, you grant us the right to use that feedback without restriction or compensation to you.

6.4 DMCA

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please follow the procedure described in our DMCA Policy. Repeat infringers will have their accounts terminated.


7. Disclaimers and Accuracy Limitations

In short: Our pricing estimates are tools, not guarantees. eBay comp data may be incomplete or stale. We make no warranties about results.

7.1 Estimates Are Not Guaranteed

The resale price estimates, Pick/Leave recommendations, and profit projections provided by Picker Radar are generated algorithmically based on historical eBay sold-listing data and AI image analysis. They are provided for informational purposes only and do not constitute a guarantee of any actual resale price, sale, or profit. Actual results may differ materially.

7.2 eBay Comp Data Limitations

Comparable sold-listing data is sourced from publicly available eBay listings via a third-party data service. This data may be incomplete, stale, seasonally skewed, geographically limited, or otherwise inaccurate. We do not verify the accuracy of individual comps. You are solely responsible for your purchasing and resale decisions.

7.3 Not Financial Advice

Nothing in the Service constitutes investment, financial, legal, or tax advice. You should consult qualified professionals for advice specific to your situation.

7.4 AI Identification Limitations

Item identification is performed by AI vision models and is subject to errors, misidentification, and omissions. Brand, condition, edition, and authenticity determinations made by the Service are estimates only.

7.5 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.


8. Limitation of Liability

In short: Our liability is capped. We're not responsible for lost profits or consequential damages.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Qualuxe Goods LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.


9. Indemnification

In short: If your misuse of the Service causes us to face a claim, you're responsible for the cost of defending it.

You agree to indemnify, defend, and hold harmless Qualuxe Goods LLC and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms; (b) Your Content; (c) your violation of any applicable law or third-party right; or (d) your negligence or willful misconduct.


10. Termination

In short: You can close your account any time. We can suspend or terminate accounts that violate these Terms.

10.1 Termination by You

You may close your account at any time by contacting us at support@pickerradar.com or through the account settings page. Closure stops future billing but does not automatically issue a refund; see our Refund Policy.

10.2 Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if we reasonably believe your continued use creates risk to us or other users. We will try to give advance notice where practicable, but are not required to do so for serious violations.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, 9, 11, and 12 survive termination. Your Content is retained for 30 days after account closure and then deleted per our Privacy Policy.


11. Dispute Resolution and Arbitration

In short: Disputes go to binding arbitration, not court. You waive the right to join a class action.

11.1 Informal Resolution First

Before initiating formal proceedings, you agree to contact us at support@pickerradar.com and give us 30 days to resolve the dispute informally.

11.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in court for violations of intellectual property rights.

Arbitration shall be conducted in Salt Lake County, Utah (or by phone/video at your election if the claim is under $10,000), and judgment on the award may be entered in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AND Qualuxe Goods LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

11.4 Small Claims Exception

Either party may bring individual claims in small claims court if the claim qualifies and remains in small claims court.


12. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. To the extent any dispute is not subject to arbitration (e.g., injunctive relief), you and we consent to the exclusive jurisdiction of the state and federal courts located in Salt Lake County, Utah.


13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email to your account address or by posting a notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must cancel your account before the effective date.
